November 23 Created at Charleston, Tennessee from three companies of the 1st Infantry Battalion of Hillyard’s Alabama Legion, under the command of Major Nicholas Stallworth. The companies were:

Company E, Chambers County, Captain John W. L. Daniels
Company F, Conecuh County, Captain William E. Broughton 
Company G, Montgomery County, Captain John Hackett Hold

Captain William E. Broughton of Company F was killed. Captain Samuel Salter took command of the company.

July Assigned to Gracie’s Brigade, Johnson’s Division, Department of North Carolina and Southern Virginia
July 21 Captain J.M. White of Company E died in service.

Battle of the Crater
September 20 Major Stallworth retired. Captain John Hackett Hold of Company G was promoted to major and took command of the battalion.  Captain William Middleton took command of Company G.
October Assigned to Gracie’s Brigade, Johnson’s Division, 4th Corps, Army of Northern Virginia
December 6 Captain John W.L. Daniels of Company E retired. Second Lieutenant James A. Lampley took command of the company.
December 12 Captain William Middleton of Company G retired. Captain Robert H. Molton took command of the company.
