May 28 Organized for state service, consisting of eight companies of infantry, two companies of artillery and an artillery company, Commanded by Colonel Charles Smith, Lieutenant Colonel Louis C.H. Finney and Major Nathaniel R. Cary.
July 1 Transferred to Confederate Service.
May Assigned to the Eastern Shore of Virginia (the part of Virginia in the Delmarva Peninsula disconnected from the rest of the state by Chesapeake Bay)  in the Department of Norfolk.
November Ordered to evacuate the Eastern Shore but was unable to do so and efforts to reorganize the regiment were unsuccessful.
1862
February 3 Mustered out per Special Orders #20, Adjutant and Inspector Generals Office. Many men joined the 19th Virginia Heavy Artillery.
