Much of the regiment was captured and paroled. Those who were not captured were organized into four companies of the 26th Virginia Infantry Battalion and never returned to the regiment. Attached to Department of Richmond, Wise’s Brigade

May 9 Companies I and K of the 20th Virginia Infantry transferred to the 59th Virginia Infantry Regiment as Companies D and F.

September The part of the regiment that had been captured and paroled at Roanoke Island was declared exchanged and returned to duty. Assigned to Department of North Carolina and Southern Virginia.

October 27 Companies I and K returned to the 59th Virginia Infantry Regiment as Companies B and C.
November 1 Merged with the 28th Virginia Infantry Battalion. Lieutenant Colonel Anderson was dropped in the regimental reorganization
